Subject To simply means a property is being transferred from the seller to the buyer “subject to” some condition. Virtually all properties today are sold subject to. . . . . easements, right of ways, home owner association covenants etc. However before the early 80’s a lot of properties were also sold subject to the existing financing on the property. This allowed the buyer to buy the property and continue to make the mortgage payments already established by the seller.
